27-year-old Alpha Yayah Kamara and Babatunde Decker, alias Boyka, appeared before Magistrate Sahr Kekura of the Pademba Road Magistrate Court No 1 in Freetown.
Both accused persons were arraigned before the court on two count charges conspiracy to commit a felony- contrary to law and robbery with aggravation contrary to Section 23(1) (a) of the Larceny Act of 1916, as repealed and replaced by Section 2 of Act No.16 of 1971.
It was alleged that, on Friday, 22nd December, 2023, in Freetown, the accused persons conspired together with other persons unknown to commit a felony to wit robbery with aggravation.
Police prosecutor, Inspector Sellu TAP, led in a factual witness, Francis Tommy, who is a police officer with the rank of Assistant Superintendent of Police, attached at the Cooperation Unit as cooperation officer,Lumley Police Station.
The prosecuting witness, ASP Tommy, told the court that he only knew the first accused person and the complainant.
In a bid to narrate to the court what occurred between the complainant and the accused persons, ASP Tommy tangled along the line, so he was unable to make his testimony solid in the court.
Meanwhile, Magistrate Kekura asked the state counsel to seek for an adjournment date for him to have proper conference with his witness, for which he did.
Defending both accused persons, Lawyer A. Kargbo applied for a bail pursuant to Section 79 (2&3) of the Criminal Procedure Act 1965.
Due to the gravity and seriousness of the alleged crime committed by both accused persons, Magistrate Kekura denied them bail and remanded both accused persons to the Male Correctional Center on Pademba Road.
The matter was adjourned to the 7th of February, 2024, for further hearings.
