Man, 22, discharged

Magistrate Albert J. Moody of the Freetown Magistrates’ Court No.2 yesterday discharged Alpha Conteh, 22, who had been arraigned for allegedly penetrating a four-year-old girl, for lack of sufficient evidence.
At the close of the preliminary investigation, the trial magistrate noted that there was insufficient evidence before him to warrant the committal of the matter to the High Court for further trial.
The accused was charged with one count of sexual penetration of a child.
Police prosecutor, Inspector Kellie Dumbuya, alleged that Conteh had engaged in a sexual penetration with a four-year-old girl at Allen Town, east of Freetown, on 16 February, 2015.
However, Magistrate Moody said evidence adduced in court, including by the mother of the alleged victim, was inconclusive as to whether she was penetrated by the accused. He added that even the medical report showed no physical rupture.
“The evidence before the court for sexual penetration is not sufficient for me to commit this matter to the High Court; I therefore discharge this matter,” the magistrate ruled.
