Sexual penetration matter discharged for want of prosecution

Magistrate Albert Moody of Court No.1 last Friday (28th July, 2017) discharged one Jinnah Aruna Gbondo, who was accused of sexually penetrating a 9-year old girl on 25th March, 2017, in Freetown.

Gbondo made his eleventh appearance before Magistrate Moody after he was arrested on 28th May, 2017, and charged with Sexual Penetration of a Child contrary to Section 19 of the Sexual Offences Act of 2012.
He made his first appearance at the Siaka Stevens Street Magistrate Court in Freetown on 30 May, 2017, with his matter adjourned for ten consecutive times without any prosecution or witness to testify.
Prior to the 10th adjournment on Friday 21st July 2017, Counsel for the accused, H.I. Ahmed, applied that the latter be discharged, if the prosecution failed to summon witness to testify in the matter.

However, Magistrate Albert Moody granted the accused bail in the sum of Le45 million, stating that if the prosecution fails to bring their first witness by the next adjourned date, he will consider any application made in line of justice.

In a related matter, thirty two years Mohamed Jalloh has also been remanded for the offence of sexual penetration contrary to law.

It was alleged that the accused person on a date in May, 2017,Back of Old School, Hill station, in Freetown, sexually penetrated a girl below eighteen years to wit fourteen.
