Police witness to be cross examined

Jaraitu Jollah, Alusine Sesay,Mohamed Korgbo, and  Idrissa Sesay, have  made several appearances before Magistrate Hadiru Daboh presiding over Ross Road Court No.3  for assault and disorderly behaviour.

The accused persons were before the court on two counts of assault occasioning actual bodily harm contrary to Section 47 of the Offences Against the Persons Act of 1861 and disorderly behaviour contrary to Section 12 of the Public Order Act No.46, of 1965.

According to the indictment, the accused persons on Sunday, 6th September 2020, at Mellon Street, Wellington in Freetown, assaulted Alfred Juhous in a manner thereby occasioning actual bodily harm and did behave in a disorderly manner.

Sergeant 10240 Sanoh  B.A. currently attached at Adonkia Police Station,Goderich,recognised the complainant and accused persons as well.

He recalled on the 6th of September, 2020, while on duty at Kissy Police Station, the complainant made a report of assault.

 He said Detective Sergeant 10769 Conteh A . issued a police medical report form on the 7th September, 2020, and that the complainant returned to the station with an endorsed medical form.

 He said since then, the report has been in the custody of the police.

The said report was produced and tendered in court to form part of the court records marked as exhibit A.

He said he further obtained statement from the complainant and witness and later extended invitation to the accused persons.

He said on the 14, 16,  17, 18 of September, 2020, all accused persons honoured  the invitation and that Detective Sergeant 10532 Sesay A. B  voluntarily interviewed them separately.

He said  they were cautioned and questioned by 10532 Sesay A.B while he signed as the recorder.

The statement was produced and tendered in court and it was marked as exhibit B1 to 10.

He said on the 17 October, 2020,he charged the accused with the offences of assault occasioning actual bodily harm and trespass and disorderly behaviour.

 He said detective Sergeant 9169 Campbell C while he signed as the recorder.

Lawyer Campbell was not in court to cross examine the last witness for the prosecution to close their case.

Magistrate Daboh adjourned the matter to the 19th, February for cross examination.
