OSD officer gets five years jail term for killing civilian

A police officer was yesterday, Wednesday October 10, sentenced to five years imprisonment after he was convicted of the offense of manslaughter.

The convict, Abdul Gibrilla Sesay, who was attached to the Operational Support Division (OSD), was initially standing trial in the High Court for the offense of murder, but the charge was later reduced to manslaughter to which he pleaded guilty.

The state alleged that, the convict on 3rd June, 2018, in Freetown, being a police officer, shot one Ibrahim Kamara who later died in the hospital.

The charge was reduced from murder to manslaughter, after the state prosecutor Joseph A.K Sesay, applied for an amendment on the case.

He said the amendment of the case will not cause any injustice to the accused, which the court granted.

Giving brief facts of the case to Justice Monfred Sesay, the State Prosecutor narrated that, on 3rd June 2018, the family of the convict had confrontation with the deceased over a plot of land that eventually graduated into a fight.

He said the convict later went to the scene and joined in the fight and later used the gun in his possession and assigned to him by the Sierra Leone Police Force, to shoot the deceased.

He said the deceased was later taken to the hospital where he died the following day.

In his plea of mitigation, the convict pleaded with the judge to temper justice with mercy because he didn’t waste the court’s time, noting that he is a family man with three children.

He further told the court that after the incident his family residence was burnt down and all his property were looted by angry youth.

Legal Aid Board Lawyer, Komba Kanu, representing the convict, also pleaded for justice to be tempered with mercy.

 He submitted that the convict was a first time offender and that he was remorseful of his action.

He said the convict had already learnt his lesson during the time was in the Male Correctional Centre.

“I have listened to the plea mitigation by the defense counsel and considering the fact that the convict is a first time offender and have pleaded guilty to the amended offense charged and he has already spent three years imprisonment. Also for the three children he said he has, I think this court deserves to show him some mercy. Thus, you are sentenced to five years imprisonment,” he said.

The judge further stated that the five years jail term started from the day he was arrested and taken into custody.
