Man remanded for accusing Magistrate Binneh-Kamara of bribery

Magistrate Abou Bhakar Binneh-Kamara last Friday, 26th May, 2016, withdrew the bail and remanded one Amidu Fullah for accusing him and the prosecution of receiving bribe from the complainant, James Tamba Kamara.

Fullah was charged alongside Umaru Kalokoh on four counts of trespass, malicious damage, public insult & provocation, and disorderly behaviour contrary to the laws of Sierra Leone.

The prosecution had alleged that on 21st April, 2017, the accused persons unlawfully extended into the land of one James Tamba Kamara and maliciously damaged concrete foundation valued four million, nine hundred and fifty million Leones.

The prosecution claimed that on the same date, the accused used certain insulting words to the annoyance of the complainant and also behaved in a disorderly manner.

The withdrawal of the bail came after the complainant told the court that the accused threatened to kill him with a machete after he went to the construction site.

The complainant also informed the court that the accused had told him that he (the accused) was denied bail on his first appearance, because the Magistrate and the prosecution received bribe from him (the complainant).

The claim was corroborated by one Austin Siaffa, who was at the scene, where the accused made the allegations.

Defense Lawyer, C. Sawyer told the Bench that he has held a conference with his clients and had cautioned him on the matter, promising to visit the site for which they were before the court.

He noted that he was surprised to have learnt that the accused made such allegations.

Speaking in anger, Magistrate Binneh-Kamara told the Defense Lawyer that it was their responsibility to advise their ‘stupid client’ on the proceeding of court.

 “When you are representing stupid clients who don’t know their left from right, you should be in place to advise them,” he said, adding that “Bail withdrawn on the basis of the allegation which is in contravention of the safe conduct which the solicitor of the accused has vouched for,” he ordered.
