Magistrate Daboh acquits, discharges accused for duplicity

One Hamid Conteh, who was standing before Magistrate Hadiru Daboh on Ross Road Court No.3   for burglary and larceny, has been acquitted and discharged on the grounds that the charge file was duplicated.  

The accused person was before the court on two counts of burglary and larceny contrary to Section 25 (1) and 13(a) of the Larceny Act 1916. 

According to the indictment, the accused on Wednesday, 11th November, 2020, at No.182 Raymond Street in Freetown, with intent to steal, broke into and entered the dwelling house of Ibriham Sorie Kamara and stole therein one Samsung Galaxy edge mobile phone valued two million five hundred thousand Leones. 

Magistrate Daboh said the charges brought by the police against the accused were bad in law thus, “I hereby acquit and discharge the said matter out of court.

The prosecution applied for an amendment of the file, but the magistrate refused, stating that  the amendment will cause the accused injustice.
