Land fraudster remanded

One Mohamed Ibrahim Mboma was yesterday remanded at the Male Correctional Center on Pademba Road in Freetown for allegedly obtaining Le30m form a certain Bai Emmanuel Tarawallie for the purpose of a plot of land at Goderich.

Mboma was arraigned at the Freetown Magistrate Court No.2, presided over Magistrate Komba Kamanda, on six counts, including conspiracy to commit a felony, contrary to law, and obtaining money by false pretence, contrary to section 32(1) of the Larceny Act of 1916.

According to the prosecution, the accused on diverse dates between 12th July and 27th August 2009 obtained the sum of Le30m from the complainant for the purpose of procuring two plots of land at Goderich, albeit knowing same to be false.

While testifying in court, Tarawallie told the court that on the said dates, while in Kenema, he instructed his wife to meet with one Saidu Kanu, a contractor, to go look at a land situated  at Goderich.

He said his wife later told him that Kanu showed her a land which cost Le30m. He said he sent Le28m  through bank transfer to Kanu, before his wife met the accused who was introduced as vendor of the land.

He further told the court that the accused confirmed he had received Le28m and was expecting the balance of Le2m, adding that the final payment was done in the presence of the accused lawyer, and with both parties signing, while the lawyer signed  as witness.

He said a surveyor was then sent to survey the land, but he was stopped by some people.  “I then called the accused and informed him and he gave me another surveyor to do the survey,” the complainant testified.

He explained that he later received a letter of summons from the High Court, which indicated that the said land belongs to another person.

“One Mr. Wellington, the uncle of the accused, told me that he is the rightful owner of the land and that if I wanted the land I should pay Le50m, which I did,” he said adding that the accused then went into hiding.

He said he made a statement at the Criminal Investigation Department before the accused was later apprehended.

The matter is prosecuted by Sergeant 922 Dumbuya J.

Magistrate Kamanda adjourned the matter to 10th December, when the defense counsel is slated to cross-examine the complainant.
