Magistrate Dr.Abou Bakarr Binneh-Kamara of Siaka Steven Street Court No.1 yesterday discharged one Alimamy Bangura, who was before the court for the offence of house breaking and larceny contrary to section 20 (1) of Larceny Act 1916.
According to the particulars of offence, Alimamy Bangura, on Saturday, 25th February, 2017, at Blackstone, New London, waterloo in the Western Rural district, broke into and entered the dwelling house of Mamadi Kamara with intent to steal and did steal fiscal cash of one million three hundred and thirty thousand Leones, property of the complainant.
Magistrate Binneh-Kamara said the accused has been in court for a long period of time and that the prosecution has not led any witness to testify in the matter.
He continued that the Bench cannot detain the accused endlessly, hence discharged him for want of prosecution witness pursuant to section 94 of the Criminal Procedure Act of 1965.
