An adult male has been jailed for 9 nine years for sexually abusing an insane girl. Abass Kargbo was yesterday sentenced at the High Court in Freetown, presided over by Justice Miatta Samba, after his conviction for sexually abusing a 15-year-old girl who suffers from insanity and epilepsy.
He had been arraigned on one count charge of sexual penetration, contrary to section 19 of the Sexual Offences Act of 2012 which stipulates that “A person who engages in an act of sexual penetration with a child commits an offence and is liable on conviction to a term of imprisonment not exceeding 15 years.”
State Prosecutor A .J.M. Bockarie had alleged that the accused on 21 October, 2014 sexually abused the victim in Freetown.
Cheryl Blake, an advocate at the Legal Aid Board, pleaded with the judge to temper justice with mercy on the grounds that her client had not wasted the court’s time by pleading guilty to the charge.
She reasoned that because the accused had been in prison since 2014 he had learnt his lessons.
But State Counsel A .J.M. Bockarie, while referring to section 35(h) of the Sexual Offences Act of 2012, noted that at the time of the incident the victim was both physically and mentally disabled, thus describing the act as “inhuman”, adding that the accused deserves no lenient sentence.
Having listened to both sides, Justice Samba sentenced the accused to 9 years imprisonment, commencing 15 March, 2016.
