23yrs old teacher granted bail on alleged theft

Sulaiman Foray, Amadu Nabie Yaya, Nabie Turay and Joseph Ivan Koroma made another appearance before Magistrate Sahr Keikura of Pademba Road Court No.1 in Freetown on two counts charges of  Conspiracy and Larceny contrary to section 2 of the Larceny Act 1916.

According to the charge sheet, on the 14th July,2021, at No. 1 Fonima Road, Goderich in Freetown, conspired together with other persons unknown and stole one Toyota FJ Cruiser Jeep with registration number ARH 222 valued two hundred million Leones from Florence Bockarie and on the same date at the same place the first accused person stole the said vehicle from the said complainant.

Prosecution witness number 1,Florence Bockarie, who is a  retired teacher identified the first accused as her driver, but never knew the second, third and fourth accused persons.

She recalled that on the 14th July, 2021,she was at home in her sitting room when the first accused person came and informed her that the vehicle  had  some breakdown and that he had taken it to the mechanic.

 The witness disclosed that she bought the car two hundred million Leones.

She said when  the accused informed that he had taken the vehicle to  the mechanic she asked one of her boys at home to give the key to the first accused for him to take it to  Aberdeen Road.

She said she later received information from the mechanic that the accused was not there with the vehicle.

The witness said she called on the first accused immediately she received the information, but that the accused didn’t pick up.

 and she called   her sister and he told her  that the accused person has gone with her car.

 and the Mechanic ask her to hold on and  gave time to  the accused person and she went to Criminal investigation department CID and  made statements.

 And she send someone at Hasting Toll gate and Maisaka Toll gate and they told her that the vehicle has past Hasting and maisaka and they give her photo and time, of the said  vehicle and it registration number and she was about tendering it but counsel representing the accused persons Gbassy Sesay objected to that  the documents is not relevant by saying there was no  indication of the said place where they took the photos of the vicheal and the prosecutor responsded  and said its their case so it is relevant and it was later tender in court.

 the witness said on the 15th July 2021 she went to Natcom for the called log of the first accused person and she saw so many called I took the third person contact which was saved as Kambia and I called my Nephew Moses Sesay at Kambia and her nephew later give her information and she called  the police officer  who gave her and information that the third accused has been arrested and he was brought to CID and the third accused told me that the vehicle has been stolen so what’s it.

The witness said he told him that the first accused person stole my vehicle and the the accused person responded to her that he did not know that it was a stolen vehicle and she got an information from a friend about the fourth accused and she went in search of him but his uncle told me that the accused person is not going to come home and she went to Natcom again and go through the first accused called log and I saw the fourth accused person number after few days she received information about the fourth accused person and she made report at Adonkia  police station and she went to the house of the fourth accused person house and he was arrested and he told her that the vehicle is in Guinea and he was transferred to CID headquarters and the fourth accused person told him that he don’t know anything about the stolen vehicle because the first accused person told him that the vehicle belongs to his sister herself the fourth accused person and some CID police officers went to Guinea upon their returned they brought the vehicle and the first,second and third accused persons and she identified the vehicle.

Counsel representing the fourth accused person M Karim applied for bail for and on behalf of the fourth accused person he made his application pursuant to section 79 sub section 2 of the criminal procedure Act 1965.

Magistrate Keikura granted the fourth accused person bail in the sum of two hundred million Leones with one surety in like sum surety must be responsible should produce identity card depicting his or her address in Freetown to be approved by the DAR

ASP Aminata Daboh prosecuting the matter adjourned to the 6th September 2021
