4 granted bail for penetrating girl, 15

Presiding Magistrate at the Pademba Road Court No.3, Abdul Sheriff, yesterday, Wednesday, April 10th granted bail to four accused persons that are currently being preliminary investigated in his court for allegedly penetrating a fifteen year-old girl.

The accused-Joel Duke-18 years, Muctar Bai Kanu- 18, Andrew Sam Sheku- 19 and Alhaji Fuad Kamar- 18, all pupils of SOS School at Lumley in Freetown, are in court to answer to two count charges of conspiracy to commit a felony to wit sexual penetration and sexual penetration contrary to section 19 of the Sexual Offences Act of 2012.

Police prosecutor, Assistant Superintendent Moses Moore, alleges that that all accused persons on 8th of February, 2019, at SOS School compound, Lumley in Freetown, conspired with other persons unknown to commit a felony to wit sexual penetration of a child.

He further alleged on count two that all accused on the same date and place, sexually penetrated their school mate, who is below the age of 18 to wit 15 years.

In her testimony, Detective Sergeant 9025 Isata Browne Minnah, attached to the Family Support Unit (FUS), Lumley Police Station,recognised all accused persons and recalled on 9th of February, 2019, when a case of sexual penetration was reported against all  of them by the father of the victim.

She said the case was assigned to her for further investigation.

 “I issued a police medical request form to the victim for examination. The medical was later returned to me and I obtained statement from the victim and witnesses,” she said.

She said on the 11th February, 2019, she obtained statement from the second and third accused persons separately and that the process was witnessed by one Detective Police Constable 1348 Hassan Sesay.

Also testifying on the same matter, Detective Police Constable 1348 Hassan Sesay, attached to the Lumley Police Station, recognised the accused persons and recalled on the 11th February, 2019, when he obtained statement from the first accused and fourth accused at the Family Support Unit (FUS), Lumley police Station.

He said on the same date he and Detective Sergeant, 9025 Isata Browne Minnah, interviewed the accused persons and that he signed as the recorder, while one Detective Police Constable 12178 Kamara L. signed as the witnessed.

“On the 27th March, 2019, I and DPC 12178 Kamara L. finally charged all four accused persons with the offenses of conspiracy to commit a felony to wit sexual penetration and sexual penetration separately. I signed the charged statement as recorder and witnessed by Detective Sergeant 9025 Isata Browne Minnah,’’ he said.

Defense Counsel, Julius N. Cuffie applied for bail on behalf of his clients, noting that they have reliable sureties that would stand in their recognizance.

He appealed that if granted bail, they would not jump bail because they have fixed address and would not interfere with witnesses.

He said the accused persons are pupils and are about to take the West Africa Senior School Certificate Examinations (WASSCE) and have been in custody for long time.

Meanwhile, Magistrate Sheriff granted bail to the accused persons in the sum of 30million Leones each, two sureties, stating that one of the sureties must produce valid NASSIT ID card, with National ID cards and that  bail must be approved by the Deputy Master and Registrar.
